What's my notice period when resigning under the Fair Work Act?

Fair Work Act 2009 (No. 28, 2009) — s 117 — Employee notice to terminate

Hi all,

I reviewed my employment agreement to confirm the notice period I must giev when resigning. The contract defers to the Fair Work Act. It specifies no fixed period.

Section 117 of the Fair Work Act 2009 (No. 28, 2009) prescribes required notice for employers only, not employees.

I am not award-covered.

Does this mean I have no contractually defined notice obligation as the resigning party? E.g., my notice could be 0 to any number of weeks.

Relevant clause:

If either you or EMPLOYER terminates your employment, the National Employment Standards of the Fair Work Act 2009 (Cth) prescribe the written notice of termination each party must give the other. In either case, EMPLOYER may choose to pay you in lieu of part or all of that notice. During any notice period, EMPLOYER may require you not to attend work and/or perform lesser or alternative duties.
